dc.description.abstractDenne oppgaven handler om hvilke oppgaver tilsynsførere under samvær pålegges av Fylkesnemnda for sosiale saker og retten. Videre omhandler oppgaven hvilken kunnskap om barn og foreldre som kan tilføres oppgavene, slik at tilsynet blir utført i henhold til pålegget og barnets beste. Hensikten har vært å bedre klargjøre forventninger som ligger til tilsynsførers arbeid, og å knytte teori til praksis. Problemstillingen er som følger: Sist, men ikke minst? Tilsynsførers pålagte oppgaver og makt. Det empiriske materialet består av kvalitative dokumentanalyser av 55 fylkesnemndsavgjørelser og 26 dommer fra ting,- lagmanns- og høyesterett i Norge. Faglitteratur om familiebehandling og en hel del barnefaglig og barnevernsfaglige teori er benyttet i oppgaven. Teorien blir trukket inn for å skape større forståelse for kompleksiteten i hva som foregår på samvær mellom barn og foreldre som har mistet omsorgen. Videre er lovverk, høringsuttalelser og veiledere gjennomgått for å finne ut av hvilke krav som stilles til tilsynsfører, og hvilke erfaringer som er gjort på feltet. I studien beskrives oppgaver som kan sies å ligge til alle tilsynsoppdrag, og det drøftes hva disse kan bety i praksis. Videre viser det empiriske materialet at tilsynsførere også pålegges andre oppgaver, og også disse blir utdypet. Et spørsmål har vært om det kan få følger for barna på samvær, dersom oppgavene som pålegges tilsynsfører ikke skriftliggjøres og utdypes tilstrekkelig. Studiens overordnede mål har vært å vurdere om barns rettsikkerhet virkelig ivaretas, når det ikke er et lovfestet krav at tilsynsførere under samvær har formell barnefaglig utdanning, og det heller ikke eksisterer kurs eller opplæring av tilsynsførere. Hvilken vekt tilsynsførers rapporter og vitnemål får når samværsakene behandles i fylkesnemnda og i retten, undersøkes derfor med tanke på om tilsynsfører har påvirkningskraft for utfallet av samværssaken. Studien viser at tilsynsoppgavene har vært lite utdypet i nemndsavgjørelser og dommer, og at tilsynsføreroppdraget for en stor del krever barnefaglig kompetanse, noe som ikke er et formelt krav i henhold til lov om barn og foreldre. Et funn er at tilsynsfører har til dels stor påvirkningskraft i saker som omhandler samvær mellom foreldre og barn, og vurderingene tillegges større vekt jo høyere saken kommer i rettshierarkiet. De mest utsatte barnas rettsikkerhet kan derfor stå i fare.en_US
dc.description.abstractMy thesis is based on the tasks supervisors are imposed by the County Council for Social Affairs and Justice during visitation (between parents and the children they have lost custody of). The thesis raises the question of professional knowledge that supervisors need in order to give an optimal picture of the situation under supervision. The aim of this thesis to clarify expectations and link theory to practice. The title being: Last but not least? Supervisors assigned tasks and the power this involves. The empirical material consists of a qualitative document analysis of 55 county board/committee decisions and 26 judgments from district, appeal and supreme courts of Norway. I founded my thesis on academic literature from family therapy and children's welfare theory. My focus is to create a greater understanding of the complexities of what goes on during visitations. Legislations, hearings, supervisors and experience from fieldwork have been reviewed in order to determine what requirements need apply to be a supervisor. The study describes all the tasks that supervisors are required to do and what this actually means in practice. The empirical material shows that supervisors are also imposed other tasks which are also elaborated on in the study. The question raised is whether these extra tasks can have consequences for children during visitation. Particularly if the tasks assigned to supervisors are neither in writing nor elaborated on sufficiently. The study's primary objective is to assess whether the children's legal rights are safeguarded. There is no statutory requirement that supervisors have a formal childcare education nor does there exist training courses for supervisors. We should therefore query the weight supervisor reports and testimonies carry with the County Board and in court, when visitation cases are dealt with. The study shows that surveillance activities are rarely elaborated on in tribunal decisions and judgments. Although supervisor assignments requires, for a large part, expertise on children this is not a formal requirement under the law of children and parents. Supervisors have considerable influence on issues concerning interaction between parents and children and their opinions weigh heavier the higher the case goes in the tribunal hierarchy. The most vulnerable children may therefore be at risk for inadequate knowledge.en_US
